Divorce - The Importance of Settling Finances

Most people, getting a divorce, want the process to be over and done with as quickly as is possible so that they can move on. It’s either for this reason or a wish not to ‘hurt’ an ex anymore than they have already or perhaps through sheer complacency that finances between divorced couples are never ‘fully’ settled.

The thing is that regardless of  the circumstances that caused the divorce and regardless of feelings and who is ‘hurting’ the most, it’s vital that a divorce is done properly and effectively to include ‘closure’ on all finances. To achieve this, we would always recommend employing the services of a ‘divorce specialist’ such as RJS Family Law. This not only stops further financial claims against you in the immediate future, but also, many months and even years further down the line.

To illustrate this point, you need to consider the Supreme Court Ruling of 2016 in the case ‘Wyatt Vs Vince.’ Dale Vince and Kathleen Wyatt had divorced decades earlier with little if any assets or finances to argue about. However, Mr Vince went on to become the Founder of a £57 million turnover, wind turbine business. The Supreme Court allowed Ms Wyatt to pursue a claim for a ‘modest,’ mortgage free home to the value of £300K – to be paid for by

Dale Vince; furthermore, the court ordered Mr Vince to make payments towards Ms Wyatt’s legal costs so that she could pursue the claim; this amounted to a further £200K. Needless to say. Ms Wyatt was successful in her claim.

Had Mr Vince used an experienced divorce lawyer, negotiations on finances, as little as they possibly were, would have been settled and a ‘Financial Clean Break Order’ would have been put in place, giving him the financial protection that he so badly required all those years later.

It’s because the details really do matter that you should talk to RJS Family Law. For a FREE initial consultation, regarding a divorce, get in touch today.
