Are Prenuptial Agreements Worth the Paper They’re Written On?

The answer to this question is now very much a ‘yes!’

Whilst popular in the US and Europe for many years, it really took until 2010 for the UK courts to properly recognise them with the help of the landmark case ‘Granatino’ Vs ‘Radmacher’ where

Katrin Radmacher successfully protected her £106 million fortune from her husband Nicolas Granatino.

Although a prenuptial agreement isn’t strictly enforceable, under English and Welsh law, an agreement that’s properly drafted by a solicitor and agreed to by both parties – using independent

Solicitors, can carry a lot of weight within a court setting.

So, if you are contemplating marriage and have significantly greater capital, by way of investments, property and inheritance, than your intended, then a prenuptial is certainly worthy of consideration.

Remember – we all marry with the best of intentions YET 42% of UK marriages end in divorce!
